Improperly Administered Field Sobriety Tests
In almost all
DUI stops, the police ask the DUI suspect to take a number of balance and
coordination tests. Contrary to popular
belief, these tests are not easy or fair.
In order for the tests to have any meaning, they have to be given under
the conditions and using the procedures given in the National Highway and
Traffic Safety Administration’s (NHSTA) Field Sobriety Test Manual. In most cases these procedures are rarely
followed, calling the results of the test and the credibility of the arresting
officer into question.
