There Were No Signs Of Mental Impairment During The Investigation And Arrest

Alcohol impacts mental impairment before it impacts physical impairment.  Mental impairment comes first.  If the officer admits that the DUI suspect reacted quickly to the officer turning on the patrol car warning lights, was able to answer all questions in a reasonable and coherent manner, locate and give the requested registration and license documents without fumbling, and otherwise acted appropriately during the encounter with the officer, this is good evidence that mental impairment was absent.  The absence of mental impairment strongly indicates that there was not physical impairment and therefore, an absence of any impairment.
