Failure Of The Arresting Officer To Conduct A Complete Investigation Of The Facts

In many cases, the arresting officer fails to ask the DUI suspect about medical conditions that might impact the field sobriety tests.  This can be exploited to show that the officer did not ask the proper questions to pre-qualify a suspect for the field sobriety tests.  The officer should also get information from the suspect about when and what the DUI suspect had to eat and drink in the previous 12 hours.  Many times this is not done.  This missing information can be the missing link in the prosecutor’s case for proving that you were over the legal limit at the time of driving.
