The Field Sobriety Tests Are Not Conclusive For
Either A Blood Alcohol Level Or Proving Impairment
The most
optimistic studies allege that when the three NHSTA standardized tests are done
exactly to NHSTA specifications and interpreted correctly by the arresting
officer, the tests can be up to 91% predictive of a blood alcohol content (BAC)
of .08 or above. It is very rare that
the tests are done correctly and interpreted correctly, so in everyday use, the
predictive value of these tests is even lower.
The studies themselves are also of questionable validity.
Evaluating
impairment is very subjective. Because
of the subjectivity and a large number of factors that can impact a DUI suspect’s
performance of field sobriety tests, field sobriety tests are a poor indicator
of impairment.
The field
sobriety tests are not conclusive on either the BAC or impairment and are poor
gauges of BAC and impairment. This is
why the field sobriety tests are followed by chemical tests.
