DMV Penalties: Los Angeles DUI

The following are the suspension periods for various offenses.
                                                                                                                  
No past DUI’s, APS actions, .08+ BAC, no chemical test refusal, age 21 and older

Four month suspension with restricted license eligibility after one month, unless there is a new arrest..

One past DUI/APS action,  .08+ BAC, no chemical test refusal, age 21 and older

One year license suspension with no restriction eligibility

Two more past DUI/APS actions, .08+ BAC, no chemical test refusal, age 21 and older

One year license suspension with no restriction eligibility

Chemical Test Refusal, No past DUI’s or APS Actions, age 21 and older

One year license suspension with no restriction eligibility

Chemical Test Refusal, one past DUI/APS action, age 21 and older

Two years license suspension, no restriction eligibility

Chemical Test Refusal, two or more DUI/APS actions, age 21 and older

Three years license suspension, no restriction eligibility

Under 21 with .01 or higher BAC, no prior DUI/APS actions

One year license suspension, with a critical needs restriction possible after 30 days.

Under 21 with .01 or higher BAC, one or more prior DUI/APS actions

One year license suspension with no restriction eligibility.

In order to obtain a restricted license, DMV will require proof of insurance, (Filing of an SR-22 Form) and proof of enrollment in a 3 month/30 hour first offender program.

The Judge in the criminal case may order an alcohol program that is longer than that required by DMV.  If your BAC is found to be excessive (.15 or greater) the judge may require you to enroll in the 9 month/60 hour program.  If the refusal allegation is dismissed in the criminal case, the judge may require the 9 month/60 hour program.
